TERMS AND CONDITIONS
New Way Photo Sessions
Booking: To secure your date and time of your session, a booking fee is to be paid upon digitally typing/signing your name to agree with contract. This booking fee will reserve the date and time of your session and will also cover all administration and preparation. This fee is non-refundable.
Payment: By signing the contract, the client acknowledges they have received, read and understand New Way Photography’s quote including the price list and inclusions.
The client agrees to pay the full balance by the due date on the invoice. Failure to do is in breach of the contract and will be deemed a cancellation with no refund to be issued.
Fees: If the client chooses a location that requires fees or permits, this will be added to the client invoice.
The Session:
Lateness: If the client is late for the session the photographer cannot guarantee that the session can proceed beyond the original end time. If final payment is made late from due date in invoice the total photo session price may be reviewed and updated to any new photo session pricing on the website or the photo session may be cancelled.
Weather: if the weather is forecast to be unfavourable for your session, there will be an option to proceed or reschedule. If the client chooses to proceed on the original date, New Way Photography will perform professionally but will not be held responsible for images affected by the weather.
Exclusivity: New Way Photography is the only photographer to perform the photographic services requested on this agreement. No other photographer is allowed to take photos at the session and no other cameras are allowed at the session unless it is a behind the scenes video.
Rescheduling: Any changes to the date and time should be requested no later than one week prior to the session. Every effort will be made to reschedule the session but there is no guarantee that the rescheduled session will be within the requested time period and will be based on mutual availability. For example, holidays and weekends book quickly. The rescheduled session must be within three months of your original booking or updated pricing will occur.
Cancellation: Booking Fee is non-refundable. In the event of client cancellation within 24 hours or less of your session appointment, all fees paid will be non-refundable. No-shows will be treated as cancellation. If for whatever reason you decide you cannot or would no longer pursue your photo session, any extra payments made on top of the non refundable deposit will not be refunded in cash form. You will receive a gift card for New Way Photography that can be regifted or can be used towards other services and products sold on my website. E.g. giftcards, flax prints, photography services within 1 year, photo composites.
Covid 19: If reschedules or cancellations are directly due to Government enforced Covid Restrictions, the client will be issued with a refund (minus the booking fee) or offered a reshoot. The booking fee is non-refundable but may be used as credit towards another session within 12 months of the original date. All sessions held will adhere to Covid Restrictions and business requirements strictly enforced.
Satisfaction: New Way Photography will assist with portrait hints and tips but will not be held responsible for the client’s final appearance, wardrobe, hair or makeup choices. In the event the session cannot proceed and needs to be cut very short due to children behaviour a mini session will be offered at no cost, if a further session is required after the mini session, it will be at full cost.
Copyright: The client agrees the Copyright in all photographs will be owned and retained by the Photographer. The client understands that these photographs are only to be used for personal use and may not be copied or reproduced unless written approval had been granted by the Photographer.
Current Prices: The prices will be locked in at the time of signing the contract and are based on the Photographer’s current pricing at the time of booking. This price list is adjusted periodically, and future bookings will be charged at the prices in effect at the time the order is placed.
Products: All orders for extra products must be accompanied by full payment. All products will remain the property of the Photographer until full payment has been made. All reasonable freight and postage may be passed to the client.
The Photographer
Due Diligence: The Photographer shall carry out this assignment with due and professional diligence. Elements beyond the Photographer's control include faulty material, equipment failure, damaged and exposed film, loss of film/photos/negatives in transit between the Photographer and professional laboratories or associates employed by the Photographer, loss or damage to film, negatives and proofs during processing and developing either by the Photographer or professional laboratories employed by the Photographer. It is agreed that the liability of the Photographer shall be limited to be a refund of any money paid under this agreement which shall be in full if all images are not deliverable or a pro-rata amount if part of the images are not deliverable as final satisfaction of any damage or loss suffered.
The digital files will be kept by the Photographer for a period of 12 months. It is the client’s responsibility to back up and secure all digital images. If retrieval is possible, there will be a retrieval fee of $100.
Emergency: In the event of an emergency or extenuating circumstance on the Photographer’s part where the Photographer is unable to attend or complete this assignment, the Photographer will reimburse the full amount, including the booking fee. The Photographer will not be held liable for services not rendered.
If any circumstance causes an unsafe or illegal environment, the Photographer reserves the right to leave the event with no refund.
In the event of civil disturbance, war, government enforced restrictions, other pandemic, declaration of a state of emergency, extreme weather events, the Photographer will offer the following options:
- rescheduling the shoot, in effect retaining your agreed package and pricing, and will defer any rescheduling fee, OR;
- a refund of money paid minus the original booking fee/retainer to cover work already completed including location scouting, meetings, administration, equipment purchase and preparation specific to your shoot.
Package Credit: Any “complimentary” bonuses or credit included with your chosen package towards prints is applicable for New Way Photography Flax Prints. This credit will expire as advised when the credit is issued. It is not transferable, redeemable for cash, nor refundable.
